1) Introduction - Welcome to the Terms of Use (hereinafter known as "Terms") for GroupTravel.org (HotelScouter.com LLC) (also known as the "Company"). The use of GroupTravel.org (HotelScouter.com LLC) (also known as the "Website") or any of its sub-domains is governed by this Terms of Use Agreement, Privacy Policy, and Disclaimer. 2) Acceptance - By using GroupTravel.org (HotelScouter.com LLC).com, any of the Company's sub-domains, or any of the Company's services, You, the User agree that you have read, understood, and agreed to the Terms of Use set forth herein. If you do not assent to these Terms, do not continue the use of GroupTravel.org (HotelScouter.com LLC).com, any of its sub-domains, or affiliated Company services. Any individual who is not legally able to make a binding agreement is similarly ineligible to use GroupTravel.org (HotelScouter.com LLC).com or any of its affiliated services. Updates will be effective upon being posted to the website. Additionally, affiliated and listed Hotels will be notified via Electronic Mail with a copy of all material changes.

4) Copyright - GroupTravel.org (HotelScouter.com LLC).com All logo's, designs, pictures, text, and information displayed on this website, are protected by the Copyright Act (codified at Title 17 of the United States Code) Any unauthorized use and or dissemination without the express written consent of GroupTravel.org (HotelScouter.com LLC) is barred by law. GroupTravel.org (HotelScouter.com LLC) reserves the right to pursue any legal remedy for damages that it experiences from the unauthorized use of copyrighted material.

5) Restrictions - The User agrees to provide GroupTravel.org (HotelScouter.com LLC).com with correct personal information when registering to become a member of GroupTravel.org (HotelScouter.com LLC).com. The User agrees to update personal information including but not limited to Email Address, Physical Address, Phone Number(s), Fax Numbers, Name Changes, and any other material changes. GroupTravel.org (HotelScouter.com LLC).com Agrees to NEVER sell your personal information. The User agrees that they are responsible to protect their own USER ID and Password. Any security compromises should be reported immediately to GroupTravel.org (HotelScouter.com LLC), failure to negligently do so may result in a suspension or termination of membership. The User is prohibited from posting or transmitting harmful, lewd, or illegal content. Additionally, transmitting harmful content that interferes with the websites operation, attempting to steal passwords from other members, and taking actions that will create an unreasonably large load on the websites infrastructure are all offenses that may result in disciplinary action not limited to suspension or termination of membership. GroupTravel.org (HotelScouter.com LLC) reserves the right to seek additional legal remedies for a breach of this nature.

5.1) Affirmation of Identity - GroupTravel.org (HotelScouter.com LLC).com will try to reasonably ascertain the identity of a User. However, GroupTravel.org (HotelScouter.com LLC).com is not responsible for any false or untrue information provided by a User due to the difficulty and unrealistic ability to absolutely determine the identity of a User.

6) Fees - GroupTravel.org (HotelScouter.com LLC).com is a free service for individuals seeking the best possible group rates. The User agrees to pay all commissions and fees associated with GroupTravel.org (HotelScouter.com LLC).com. GroupTravel.org (HotelScouter.com LLC).com is a commission based system for travel agents, referral agencies and similarly employed individuals. GroupTravel.org (HotelScouter.com LLC).com is a commission based system for hotels seeking to offer the best possible rate for groups of all sizes. The Commission as of January 2010 is 10% of the total price of the transaction excluding state and federal taxes. 6.1)Change in Fees or Fee Structure - GroupTravel.org (HotelScouter.com LLC).com is determined to provide a consistent and transparent fee structure. In the event that GroupTravel.org (HotelScouter.com LLC) makes any material changes to its fee structure, GroupTravel.org (HotelScouter.com LLC) will give the User at least 30 days notice to assent to the changes. Continued use of GroupTravel.org (HotelScouter.com LLC).com or it's services constitutes an agreement to the updated fees and fee structure.

7) GroupTravel.org (HotelScouter.com LLC) as a Market -The User agrees that GroupTravel.org (HotelScouter.com LLC).com is functioning as a market facilitator whereby the Offeror (In this Scenario :The Hotel) and the Offeree (In this Scenario : The Individual in charge of the Group Booking) are introduced to make a mutual agreement concerning the Offeree's requests and Offerers consideration for those requests. GroupTravel.org (HotelScouter.com LLC) is neither the Offeror, nor the Offerree, therefore it follows that the User releases GroupTravel.org (HotelScouter.com LLC) from any third party liability arising from contractual disputes between the Offeror and Offeree.

8) Warranty - GroupTravel.org (HotelScouter.com LLC) does not make any explicit or implied warranty for the quality of the property listed. GroupTravel.org (HotelScouter.com LLC) does not guarantee the condition, reputation, or ability of the hotel property. GroupTravel.org (HotelScouter.com LLC) does make efforts to list only reputable and respectable properties, however this attempt is done in good faith and in no way represents an implied warranty of quality.

9) Liability - The User agrees to release GroupTravel.org (HotelScouter.com LLC) from ANY liability that may arise between Users. While GroupTravel.org (HotelScouter.com LLC).com aims to provide excellent and trouble free services, GroupTravel.org (HotelScouter.com LLC) does not guarantee the successful completion of any transaction that it facilitates. It follows that the User releases GroupTravel.org (HotelScouter.com LLC).com from any liability arsing from reliance on a successful completion of a transaction.

10) General - The User agrees to complete and communicate via the channels facilitated by GroupTravel.org (HotelScouter.com LLC).com. The User understands that completion or negotiation of any transaction outside the market that GroupTravel.org (HotelScouter.com LLC).com provides is a violation of these Terms and constitutes a Breach of this Contract that may be punishable by, but is not limited to: 1) Suspension of membership 2) Termination of membership 3) Legal Damage Remedies.

11) Ancillary Matters - If any provision of these Terms is severed, the rest of the Terms survive individually and collectively. These Terms are effective as of March 1, 2010 and were last updated on September 26, 2011.
